administrativo que una asociaci\u00f3n est\u00e1 constituida por alcanzar una finalidad de inter\u00e9s general.<\/strong><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: center;\"><span #333333;\"><strong>En este blog queremos hablar del procedimiento a seguir para solicitar el reconocimiento.<\/strong><\/span><\/p>\n<p><span style=\"color: #ffffff;\">.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\"><span style=\"color: #000000;\"><strong><span style=\"text-decoration: underline;\">Los pasos a seguir son los siguientes:<\/span><\/strong><\/span><span style=\"color: #ffffff;\">.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">Escrito de solicitud dirigido al Registro de Entidades donde se especifique:<\/p>\n<ul style=\"list-style-type: square;\">\n<li>Los datos de identificaci\u00f3n de la entidad solicitante.<\/li>\n<\/ul>\n<ul style=\"list-style-type: square;\">\n<li>Las razones por las que la asociaci\u00f3n quiere ser declarada de utilidad p\u00fablica.<\/li>\n<\/ul>\n<ul style=\"list-style-type: square;\">\n<li>Informe justificativo de los objetivos de la asociaci\u00f3n para que sea considerada DUP, con especial referencia a las actividades que desarrolla de inter\u00e9s general.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">La solicitud se deber\u00e1 acompa\u00f1ar la siguiente documentaci\u00f3n:<span style=\"color: #ffffff;\">.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">1.<span style=\"text-decoration: underline;\"> Memoria<\/span> de las actividades que haya desarrollado ininterrumpidamente la asociaci\u00f3n durante los dos ejercicios econ\u00f3micos anuales anteriores a aquel en que se presente la solicitud. A tales efectos existe un modelo normalizado. Esta memoria deber\u00e1 referirse a los siguientes puntos:<span style=\"color: #ffffff;\">.<\/span><\/p>\n<ul style=\"text-align: justify; list-style-type: square;\">\n<li>Organizaci\u00f3n de los diferentes servicios, centros o funciones en que se diversifica la actividad de la asociaci\u00f3n<\/li>\n<\/ul>\n<ul style=\"text-align: justify; list-style-type: square;\">\n<li>Descripci\u00f3n de las actividades desarrolladas y de los servicios prestados durante los dos \u00faltimos a\u00f1os. (Estas actividades y estos servicios no podr\u00e1n estar restringidos exclusivamente a beneficiar a sus asociados, sino que deber\u00e1n estar abiertos a cualquier otro posible beneficiario que re\u00fana las condiciones y caracteres exigidos por la \u00edndole de los fines de la asociaci\u00f3n.)<\/li>\n<\/ul>\n<ul style=\"text-align: justify; list-style-type: square;\">\n<li>Consignaci\u00f3n de los resultados obtenidos con la realizaci\u00f3n de estas actividades.<\/li>\n<\/ul>\n<ul style=\"text-align: justify; list-style-type: square;\">\n<li>Grado o nivel de cumplimiento efectivo de los fines estatutarios<\/li>\n<\/ul>\n<ul style=\"text-align: justify; list-style-type: square;\">\n<li>N\u00famero total de beneficiarios o usuarios de las actividades o servicios que presta la entidad, la clase y el grado de atenci\u00f3n que reciben y los requisitos o circunstancias que deben reunir para disfrutar de esta condici\u00f3n<\/li>\n<\/ul>\n<ul style=\"text-align: justify; list-style-type: square;\">\n<li>Medios personales de que dispone la entidad, con expresi\u00f3n de la plantilla de personal<\/li>\n<\/ul>\n<ul style=\"text-align: justify; list-style-type: square;\">\n<li>Medios materiales y recursos con que cuenta la entidad, con especial referencia a las subvenciones p\u00fablicas y su aplicaci\u00f3n<\/li>\n<\/ul>\n<ul style=\"text-align: justify; list-style-type: square;\">\n<li>Retribuciones percibidas en los dos \u00faltimos a\u00f1os por los miembros del \u00f3rgano de representaci\u00f3n, sea por raz\u00f3n de su cargo, sea por la prestaci\u00f3n de servicios diferentes a las funciones que les corresponden como tales miembros de dicho \u00f3rgano, especificando la naturaleza laboral o mercantil de las retribuciones y los fondos con cargo a los cuales han sido abonadas<\/li>\n<\/ul>\n<ul style=\"text-align: justify; list-style-type: square;\">\n<li>N\u00famero de socios -personas f\u00edsicas o jur\u00eddicas- que integran la asociaci\u00f3n.<\/li>\n<\/ul>\n<ul style=\"text-align: justify; list-style-type: square;\">\n<li>Esta memoria debe ir firmada por los miembros de la junta directiva.<\/li>\n<\/ul>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">2. <span style=\"text-decoration: underline;\">Cuentas anuales<\/span> correspondiente a los dos \u00faltimos ejercicios cerrados al ejercicio en curso, que refleje la imagen fiel del patrimonio, la situaci\u00f3n financiera y los resultados de la entidad, firmados por el presidente y el secretario. La documentaci\u00f3n contable debe estar integrada por el balance de situaci\u00f3n, la cuenta de resultados y la memoria econ\u00f3mica. Estos documentos deben estar adaptados a las normas del Plan General de Contabilidad y sus adaptaciones sectoriales.<\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">3. <span style=\"text-decoration: underline;\">Certificado de la Agencia Tributaria y de la Tesorer\u00eda General de la Seguridad Social<\/span> que acredite que la asociaci\u00f3n est\u00e1 al corriente de sus obligaciones fiscales y de la Seguridad Social.<\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">4. <span style=\"text-decoration: underline;\">Certificado acreditativo del acuerdo de la asamblea general<\/span> por el que se ha aprobado la solicitud de la declaraci\u00f3n de utilidad p\u00fablica, emitido por el secretario con el visto bueno del presidente.<\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">5. <span style=\"text-decoration: underline;\">Certificado<\/span>, suscrito por el secretario de la junta directiva con el visto bueno del presidente, <span style=\"text-decoration: underline;\">de la composici\u00f3n de la junta directiva actual<\/span>, con la expresi\u00f3n del nombre y apellidos de cada miembro, el domicilio, el cargo que ocupa y la fecha del nombramiento.<\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">6. Fotocopia de la tarjeta acreditativa del NIF de la asociaci\u00f3n.<\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">La tramitaci\u00f3n de la solicitud se har\u00e1 en el Registro de asociaciones (Departamento de Justicia de la Generalidad de Catalu\u00f1a) y resolver\u00e1 el Ministerio del Interior. Es un tr\u00e1mite largo pero no dif\u00edcil. Desde que se empieza a preparar la informaci\u00f3n y documentaci\u00f3n, se presenta la solicitud, se responde a los requerimientos propios de la tramitaci\u00f3n (normalmente para cada expediente se asigna un t\u00e9cnico de la Direcci\u00f3n General de Derecho y de Entidades Jur\u00eddicas) y se resuelto, puede pasar tranquilamente medio a\u00f1o.<\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\"><span style=\"color: #ffffff;\">.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\" align=\"center\"><span style=\"color: #000000; font-size: 12pt;\"><strong><span style=\"line-height: 115%;\">Obligaciones de las entidades DUP<\/span><\/strong><\/span><span style=\"color: #ffffff;\">.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">Dentro de los seis meses siguientes a la finalizaci\u00f3n del a\u00f1o, deber\u00e1n presentar al Departamento de Justicia de la Generalidad de Catalu\u00f1a las cuentas anuales y una memoria descriptiva de las actividades realizadas durante el ejercicio.<\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">La documentaci\u00f3n es la siguiente:<\/p>\n<ol>\n<li>Balance de situaci\u00f3n, cuenta de resultados y memoria econ\u00f3mica, donde debe constar claramente la situaci\u00f3n econ\u00f3mica, financiera y patrimonial de la asociaci\u00f3n, firmada por todos los miembros de la Junta Directiva.<\/li>\n<li>Memoria expresiva de las actividades asociativas firmada por todos los miembros de la Junta Directiva.<\/li>\n<li>Certificaci\u00f3n expedida por el secretario con el visto bueno del presidente del acuerdo de la asamblea general de socios que contenga la aprobaci\u00f3n de la documentaci\u00f3n mencionada en los puntos anteriores.<\/li>\n<\/ol>\n<p><span style=\"color: #ffffff;\">.<\/span><\/p>\n<p style=\"text-align: center;\">\u00a0 <span style=\"color: #000000;\"><strong style=\"mso-bidi-font-weight: normal;\"><span style=\"line-height: 115%; font-size: 14pt;\">Acogida a la Ley 49\/2002 de r\u00e9gimen fiscal de las entidades sin \u00e1nimo de lucro y de los incentivos fiscales al mecenazgo.<\/span><\/strong><\/span><span style=\"color: #ffffff;\">.<\/span><\/p>\n<p><span style=\"color: #ffffff;\">.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">Si la entidad solicitante es Declarada de Utilidad P\u00fablica y quiere aplicar el r\u00e9gimen fiscal especial de la Ley 49\/2002 debe cumplir los siguientes requisitos:<\/p>\n<ol>\n<li>Que la entidad persiga fines de inter\u00e9s general.<\/li>\n<li>Que se destine al menos el 70% de sus rentas en la realizaci\u00f3n de sus fines.<\/li>\n<li>Que la actividad realizada no consista en el desarrollo de explotaciones econ\u00f3micas ajenas a sus fines estatutarios.<\/li>\n<li>Que los fundadores, asociados y miembros del \u00f3rgano de gobierno no sean los destinatarios principales de las actividades que realiza la entidad.<\/li>\n<li>Que los cargos de miembro de la Junta Directiva sean gratuitos<\/li>\n<li>Que en caso de disoluci\u00f3n de la entidad, la totalidad de su patrimonio se destinar\u00e1 a otra entidad considerada beneficiaria de mecenazgo a efectos de la ley o a entidades que persigan fines de inter\u00e9s general.<\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #ffffff;\">.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: center;\"><span style=\"color: #808000;\"><strong>Asesor\u00eda en Barcelona<\/strong><\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"color: #808000;\"><strong>SAGARRA i MONTALVO GESTI\u00d3 BCN<\/strong><\/span><\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>.
